Fitz is still alive, frozen on a ship in space somewhere. Jemma and the crew went to space at the end to find him. It's what Coulson implied when he told Jemma to find him.

That's a good point, maybe SHIELD has a rank structure that they don't talk about that has the authority to marry people, I think Colonels and above in the Military can marry people, so maybe SHIELD has the same thing.

From a TV show I watch where a couple got married.

After they exchanged vows the person officiating said:

"By the power vested in me by: evenyoucanperformweddings.com I now pronounce you husband and wife."

I guess it is just Art imitating life.
